GENERAL CONDITIONS as of 27/10/2023

1- Purpose

These general conditions apply to the use of the websites of SARL EFANDJI and to the sale of the transportation services it offers.

2- Ownership

The websites efandji.fr, vagnat-driver.fr, and atlanticdriverprestige.com are owned by SARL EFANDJI, a limited liability company with a capital of €2,000, registered at the Bordeaux RCS under the number 832 874 093, located at 11 Rue Marie Curie, 33320 Eysines.

3- Intellectual Property

The content of the sites is protected by intellectual property laws. Any reproduction or use, in any form and on any medium, is prohibited without prior written consent from SARL EFANDJI.

4- Vehicle Reservation

a- Driver Assignment

After a ride is registered, it obtains the status 'Waiting for assignment'. Once payment is made (except for account customers), a driver is assigned to the ride. The passenger receives by email, a few days before the start of the ride, information about the assigned driver.

b- Confirmation

Reservations, whether made online, by phone, or via a quote, are only confirmed after full payment (except for account customers) and receipt of the reservation voucher marked 'accepted' or the deposit invoice for quotes.

5- Client Obligations

  • The client agrees to check their reservation voucher received by email before the day of their reservation and to keep it in case of a dispute.
  • Smoking in the vehicle is strictly prohibited
  • Wearing a seat belt is mandatory in both the front and back seats; clients failing to comply will face a fine that remains their responsibility.
  • In no case can the client demand that the driver exceed the speed limit or commit traffic violations; the driver must respect and enforce the laws in force.
  • SARL EFANDJI reserves the right to interrupt the service in progress if the client commits an offense, examples: drug use, alcohol consumption, or inappropriate remarks towards the driver or a person inside or outside the vehicle, and if the client endangers the safety of the driver or others.

6- Responsibilities

a. Client

- Duty of Control

The client will be held responsible even in the case of an operator's error if they have not corrected a visible mistake on their reservation voucher.

- Damages

Any damage caused by the client inside or outside the vehicle will be their responsibility (e.g., door opening), unless it can be demonstrated that it was caused by a third party. Any client caught smoking inside a vehicle will be charged a cleaning fee of €500.

- Convoys

The client must take all necessary measures to secure the convoy (private security, police protection...). They will be held responsible for any damages that occur during their transfer on the vehicles of the convoy.

b. SARL EFANDJI

The company commits to doing everything possible to carry out the mission entrusted to it, subject to force majeure independent of its will. (Weather conditions, driver incapacity, last-minute breakdown, prefectural decrees, wars, terrorist attacks...)

- Insurance

The liability of SARL EFANDJI is limited to the clauses of its insurance contract, its professional insurance 'subscribed for the transport of passengers for a fee' which covers passengers transported for a fee on board the sedan in the event of an accident with bodily injury, in accordance with French regulations: article L3120.4 of the transport code and under the decree of April 18, 1966, relating to the conditions for exercising the profession of Vehicle Transport with Chauffeur (VTC).

7- Cancellation

a. Orders based on quotes

Cancellations must always be communicated in writing to contact (at) efandji.fr .

Cancellation conditions for quotes, the following will be retained:

  • 30% of the service price if cancellation occurs between 30 and 21 days before departure
  • 50% of the service price if cancellation occurs between 20 and 8 days before departure
  • 75% of the service price if cancellation occurs between 7 and 3 days before departure
  • 90% of the service price if cancellation occurs between 2 days before and the day before departure
  • 100% of the service price if cancellation occurs on the day of departure.

b. Orders on the website, by phone, or by any electronic means.

  • The client may cancel their ride at any time by email to contact (at) efandji.fr .
  • As drivers' schedules cannot be infinitely adjusted, a portion of the funds will be returned according to the following conditions:
  • + 48 hours before the ride – 95% refund
  • Between 24 and 48 hours before the ride – 50% refund
  • Less than 24 hours before the ride – No Refund

8- Account Clients

Account clients benefit from deferred payment by direct debit.

Account clients are subject to the same cancellation conditions outlined in article 7.

9- Disputes

Any claim will only be accepted within a period of 120 hours after the performance of the service, after which time only the Commercial Court of BORDEAUX will have jurisdiction.

10- Changes to the Terms and Conditions

SARL EFANDJI reserves the right to modify its terms and conditions of sale at any time.

The applicable terms and conditions of sale are those in force on the date of the conclusion of the contract with the Client.

For any online order, it is appropriate to print the terms and conditions on the day of the order.

11- Acceptance

Outside of quotes, the client can receive the terms and conditions in PDF format only if they request it. They can also print or save them directly from this page.

By doing so, the Client declares having read the General Terms and Conditions before placing an online order and accepts them without reservation.

Any order constitutes acceptance of the current terms and conditions of service provision.

Estimate / Booking
